Course Description:
Many employers do all the right things — update handbook policies, train managers, investigate any EEO concerns raised, discipline employees appropriately. Yet, these same employers will inevitably be on the receiving end of an unexpected federal or state charge of discrimination. Once the initial shock wears off, employers facing this situation are left with many questions and concerns: what to do, when and how to do it and (perhaps most pressing) how to resolve the matter as quickly and cost-effectively as possible. This seminar is designed to provide basic background information for human resources professionals, in-house counsel and company executives concerning the handling of EEOC and state agency charges, with an emphasis on discrimination, harassment and retaliation claims.
  • Initial strategy decisions in handling a new charge or complaint.
  • The basics of document preservation and why it is so important.
  • How a charge proceeds through the agency/court process.
  • Determining whether to mediate, settle or litigate.
  • Unique consideration when the complainant/plaintiff is still employed by the company.
