The FMLA provides that employees may not be retaliated against for exercising their rights under the FMLA. When an employee has attendance or other disciplinary issues, however, an employer must strike a delicate balance between appropriate corrective action and the appearance of retaliation. This one hour webinar will review best practices to manage employees without fear while being mindful of avoiding unreasonable, including:
  • Managing employee attendance while not running afoul of the FMLA
  • Distinguishing between impermissible discipline for FMLA-covered absences and permissible discipline for violations of call-out procedures
  • Using effective performance management to limit the risks of a retaliation claim
  • How to properly and timely document performance decisions to minimize the impact of intervening medical and leave issues
